EMGS MOBILE APP PRIVACY POLICY
We at EMGS, and our servants and agents, which means EMGS and its subsidiaries from time to time and their subsidiaries, ("we", "us", "our" or "EMGS" as the context requires) are committed to protecting and respecting your privacy.
This privacy policy governs your use of the software application EMGS Mobile App ("Application") for mobile devices. This Notice applies to all data processed in Malaysia, the transmission of information through this site will send data to the legal jurisdiction of Malaysia and the Personal Data Protection Act 2010 is deemed to apply, unless a court or other tribunal or decision-making body with relevant authority rules otherwise.
What information does the Application obtain and how is it used?
User Provided Information
The Application obtains the information you provide when you download and register the Application. Registration with us is optional. However, please keep in mind that you may not be able to use some of the features offered by the Application unless you register with us.
When you register to use the Application, the Application will verify (a) your iKad (Immigration card) information and match it with the travel document information on our systems; (b) information you provide us when you contact us for help and; (c) information you enter into our system when using the Application, such as contact information.
We may also use the information you provided us to contact your from time to time to provide you with important information, required notices and marketing promotions.
Automatically Collected Information
In addition, the Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, and your mobile operating system version.
Does the Application collect precise real time location information of the device?
When you use the Application, we may use GPS technology (or other similar technology) to determine your current location in order to determine the city you are located within and display a location map with relevant directions to our offices. We will not share your current location with other users or partners.
If you do not want us to use your location for the purposes set forth above, you should turn off the location services for the Application located in your mobile phone settings.
Do third parties see and/or have access to information obtained by the Application?
We will share your information with third parties only in the ways that are described in this privacy statement.
We will share personal information, including personal data included in the Application, or which you subsequently supply to us, with the staff of EMGS and their sub-contractors and any government authorities in accordance with the applicable law.
EMGS or their authorized representatives, partners or subsidiaries will take all reasonable precautions to protect the security of your data however we cannot be liable to you for any loss or damage suffered by you as a result of an unauthorised third party having accessed your data.
We may, on occasion, be required to undertake a check on the identity of Application Users or Students in order to prevent fraud or misuse of the Application or EMGS services.
EMGS will cooperate, where it is required to do so, with enquiries from authorities which demonstrate a legal requirement for access to information about you. These include, but are not limited to: Malaysian and International Police Forces, the Malaysian Department of Immigration, the Malaysian Ministry of Education and any other bona fide investigators on behalf of other agencies pursuing a lawful enquiry.
Opt-out rights
You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.
Data Retention Policy, Managing Your Information
Data will be held in accordance with the requirements of the Malaysian Government departments handling tax, immigration, health and education.
Please note that some or all of the User Provided Data may be required in order for the Application to function properly.
Security
We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.
EMGS or their authorized representatives, partners or subsidiaries will take all reasonable precautions to protect the security of your data however we cannot be liable to you for any loss or damage suffered by you as a result of an unauthorised third party having accessed your data.
Changes
This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy here and informing you via email. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.
Your Consent
By using the Application, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. "Processing," means using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in Malaysia. If you reside outside Malaysia, your information will be transferred, processed and stored there under Malaysian privacy standards.
Your right to ask to see the information we hold about you
Upon the coming into force of the Personal Data Protection Act 2010 you may request for us to provide you with details of personal information that we hold about you. If you want to make a request for this information you should write to the Data Protection Officer, EMGS, 20th Floor, Menara TA One, 22 Jalan P. Ramlee, Kuala Lumpur Malaysia 50250. There will be a fee of RM10 payable to "EMGS Escrow Account 1". A bank draft for this amount should be sent to EMGS with your request for information.
If you request us to do so we will consider making changes to the information that we hold about you. We will change certain limited information that we hold about you where you tell us it is incorrect.
